DEFINITIONS

In these terms:

‘Goods’ means the blinds, curtains or shutters (or similar goods) supplied by us, which are the subject of your Order.

‘you’ means the person or entity ordering the Goods from us.

‘Bracken Blinds’ or ‘we’ or ‘us’ means The Blinds Collective Pty Ltd (ABN 59675598400) trading as Bracken Blinds.

By accessing or purchasing through brackenblinds.com.au (the “Site”), you agree to these Terms & Conditions. If you do not agree with any part of these terms, please do not use the Site or place an order.


1. Custom-Made Products

All Bracken Blinds products are made-to-measure specifically for you based on the measurements, fabrics, options and configurations selected. Because items are manufactured to order:

  • Change-of-mind returns are not available.
  • Your rights under Australian Consumer Law (ACL) remain fully intact.

2. Measurement Responsibility

2A. Bracken Check-Measure (Recommended)

If Bracken performs a check-measure prior to production, Bracken Blinds becomes fully responsible for the final manufacturing measurements. Production will only commence after check-measure verification.

2B. Customer-Supplied Measurements

If you provide your own measurements, you accept full responsibility for accuracy. Any remakes, adjustments or replacements required due to incorrect customer measurements will be at your cost.


3. Order Confirmation & Production

An order is considered confirmed when:

  • A 50% deposit is paid at checkout, or
  • Formal email approval is provided for a quoted order.

Production begins after check-measure (if booked) or immediately for self-measured orders. Once production begins, orders cannot be cancelled or modified.


4. Deposits, Pricing & Payments

  • A 50% deposit is required to confirm your order.
  • The remaining balance is due prior to or on installation day.
  • Prices are in AUD and may change without notice until an order is placed.
  • Deposits are non-refundable once production has begun.

5. Variations, Tolerances & Fabric Characteristics

Industry-standard tolerances apply:

  • Size tolerance of ±3mm (or manufacturer-specified tolerances).
  • Minor differences in colour, texture, weave, dye lot or sheen may occur.
  • Fabric movement caused by heat, humidity or installation environment is normal.

These variations are not considered defects.


6. Product Visuals & Online Configurator

The design tool, swatch images, diagrams and previews are representational tools only. Actual product appearance may vary due to screen calibration, texture, lighting and fabric variation. The order summary at checkout constitutes the final specification.


7. Lead Times

Lead times vary by product:

  • Curtains & Outdoor Products: approx. 4–6 weeks
  • Roller Blinds: approx. 3–4 weeks
  • Roman Blinds & Pelmets: approx. 4–6 weeks
  • Plantation Shutters: often 8–12+ weeks depending on manufacturer

Lead times are estimates only. Bracken Blinds is not responsible for delays caused by manufacturers, shipping carriers, customs, public holidays or force majeure events.


8. Installation Requirements

Please ensure:

  • Clear access to all installation areas.
  • All walls, ceilings, reveals and window frames are structurally sound.
  • Any obstructions are removed prior to installation.

Additional charges may apply for:

  • Repeat visits due to access issues
  • Obstructions that require removal
  • Unexpected structural or building complications

Bracken Blinds is not responsible for pre-existing defects, fragile surfaces, or builder/renovation-related issues.


9. Check-Measure & Appointment Conditions

  • Appointment times are approximate.
  • An adult aged 18+ must be present.
  • Missed appointments may incur a rebooking fee.
  • If site conditions change after check-measure, price adjustments may apply.

10. Delivery (Non-Installation Orders)

  • Risk transfers to the customer once goods are delivered to the provided address.
  • Transit damage must be reported within 48 hours of delivery, with photographs.

11. Faults, Defects & Warranty

If a product is faulty, you may be entitled to repair, replacement or refund under the ACL. Manufacturer warranties (typically 3–5 years) apply depending on product and fabric.

Warranty does not cover:

  • Incorrect customer measurements
  • Misuse or improper cleaning
  • Moisture, mould or water damage
  • Environmental conditions beyond product suitability
  • Damage caused by DIY installation

12. Order Cancellation

Because all products are custom-made, cancellations are not possible once production has begun. Administrative fees may apply for cancellations prior to check-measure.


13. Shipping

  • Shipping costs are calculated at checkout.
  • Bracken Blinds is not liable for carrier delays.

14. Limitation of Liability

To the extent permitted by law, Bracken Blinds is not liable for indirect or consequential loss. Our liability is limited to the repair, replacement or refund of goods up to the purchase price.

Your rights under the Australian Consumer Law remain unaffected.


15. Privacy

Your personal information is used only for processing orders, scheduling check-measure and installation, and internal operations. We do not sell customer data. Information is stored securely in accordance with Australian privacy requirements.


16. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes will be handled in the courts of Victoria.


17. Changes to Terms

Bracken Blinds may update these Terms periodically. Continued use of the Site constitutes acceptance of any updated Terms.
